{"id":2624,"date":"2017-05-31T06:38:23","date_gmt":"2017-05-31T06:38:23","guid":{"rendered":"https:\/\/www.voice.global\/huge-victory-for-indigenous-people-in-kenya\/"},"modified":"2018-04-12T14:08:09","modified_gmt":"2018-04-12T12:08:09","slug":"grande-victoire-pour-les-populations-indigene-au-kenya","status":"publish","type":"post","link":"https:\/\/voice.global\/fr\/grande-victoire-pour-les-populations-indigene-au-kenya\/","title":{"rendered":"Grande Victoire pour les Populations Indig\u00e8ne au Kenya\u00a0\u00a0\u00a0"},"content":{"rendered":"<p><a href=\"http:\/\/fr.african-court.org\/\" target=\"_blank\" rel=\"noopener\">La Cour Africaine des Droits de l&rsquo;Homme et des Peuples<\/a> d&rsquo;Arusha a rendu un jugement historique en faveur de la communaut\u00e9 Ogiek du Kenya &#8211; l&rsquo;une des derni\u00e8res communaut\u00e9s foresti\u00e8res parmi les peuples autochtones les plus marginalis\u00e9s du pays. Cela est intervenu \u00e0 la suite d\u2019une longue bataille juridique qui a dur\u00e9 huit ans, men\u00e9e par le partenaire Voice Minority Rights Group International, le programme de d\u00e9veloppement des peuples Ogiek et CEMIRIDE.<\/p>\n<p>Pendant des d\u00e9cennies, les Ogiek ont \u00e9t\u00e9 syst\u00e9matiquement soumis \u00e0 des expulsions forc\u00e9es arbitraires par le gouvernement de leurs terres ancestrales dans la for\u00eat des Mau, sans consultation ni compensation. Cela a eu des effets n\u00e9fastes sur la poursuite de leur mode de vie traditionnelle, de leurs vies religieuses et culturelles, de l&rsquo;acc\u00e8s aux ressources naturelles et de leur existence m\u00eame en tant que peuple autochtone. Aujourd&rsquo;hui, la Cour a conclu que le gouvernement kenyan avait viol\u00e9 sept articles distincts de la <a href=\"http:\/\/www.achpr.org\/instruments\/achpr\/\" target=\"_blank\" rel=\"noopener\">Charte africaine<\/a>.<\/p>\n<p>Le travail de l&rsquo;\u00e9quipe juridique de MRG a \u00e9galement \u00e9t\u00e9 pr\u00e9sent\u00e9 dans une <a href=\"https:\/\/www.opensocietyfoundations.org\/sites\/default\/files\/slip-land-rights-20170424.pdf\" target=\"_blank\" rel=\"noopener\">\u00e9tude r\u00e9cente<\/a> de <em>l&rsquo;Open Society Justice Initiative <\/em>qui a examin\u00e9 l&rsquo;impact des communaut\u00e9s autochtones \u00e0 travers le monde en utilisant des contentieux strat\u00e9giques pour faire valoir leurs droits fonciers. L&rsquo;\u00e9tude a r\u00e9v\u00e9l\u00e9 que, bien qu&rsquo;il ne s&rsquo;agisse pas d&rsquo;une panac\u00e9e, les litiges strat\u00e9giques comme ce cas peuvent avoir un impact important sur les communaut\u00e9s concern\u00e9es, ainsi qu&rsquo;un impact plus large sur la sensibilisation, la r\u00e9forme des cadres juridiques.
